Kodak Black is asking a Florida court to remove all remaining bond conditions in his felony drug trafficking case, claiming prosecutors failed to file formal charges within the timeframe required under state law.
The rapper's legal team filed the motion in Orange County, arguing the State Attorney's Office missed the statutory deadline after his arrest earlier this year.
Kodak Black Challenges Bond Conditions
According to court filings, Kodak Black—whose legal name is Bill Kapri—was arrested on May 6 on a felony charge of trafficking MDMA.
His attorneys argue that Florida Rule of Criminal Procedure 3.134 generally requires prosecutors to file an information or obtain an indictment within 60 days of an arrest.
The motion claims that deadline expired on July 5, but no formal charging document had been filed.
Attorneys Say State Missed Filing Deadline
Kodak Black's legal team contends that Florida law provides only two options if prosecutors fail to meet the deadline.
According to the motion, the court must either:
Release the defendant on their own recognizance, or
Allow prosecutors a limited extension if they can demonstrate good cause.
The rapper's attorney is asking the court to remove all of Kodak Black's current bond conditions unless prosecutors can justify keeping them in place.
Drug Trafficking Charge Stems From 2025 Investigation
The case originated from an Orange County Sheriff's Office investigation following reports of gunfire at the Children's Safety Village in November 2025.
During the investigation, deputies searched two vehicles after reportedly detecting the smell of burned cannabis.
Authorities say they recovered a pink bag containing suspected MDMA, which investigators later linked to Kodak Black through photos allegedly posted on his Instagram account.
The Florida Department of Law Enforcement later determined the quantity of the substance met the state's trafficking threshold.
Kodak Black Was Released on $75,000 Bond
Following his arrest, a judge set Kodak Black's bond at $75,000, citing his prior felony convictions.
The rapper later secured his release after posting bond and has remained subject to court-imposed conditions while the case proceeds.
Motion Does Not Challenge the Charges
Importantly, Kodak Black's latest filing does not seek dismissal of the trafficking charge itself.
Instead, his attorneys are asking the court to determine whether prosecutors complied with Florida's mandatory charging deadlines and, if they did not, to remove the bond restrictions currently imposed on the rapper.
A judge has not yet ruled on the motion.
