Halle Berry and Olivier Martinez’s bitter custody battle has taken another dramatic turn.
A judge has granted Martinez a temporary restraining order against the Academy Award-winning actress after he accused Berry of physically abusing their 12-year-old son, Maceo.
According to court documents, Martinez claims Berry allegedly grabbed Maceo around the neck and choked him during a recent confrontation at her home.
Berry has strongly denied the allegations, with her attorney calling Martinez’s claims “entirely meritless and deliberately misleading.”
Olivier Martinez Accuses Halle Berry Of Choking Their Son
Martinez alleges the incident occurred while Maceo was playing a virtual reality game inside Berry’s home.
According to his filing, Berry allegedly became upset with their son before the confrontation turned physical. Martinez claims she placed her hands around Maceo’s neck and choked him.
Berry’s longtime partner, musician Van Hunt, was allegedly at the home when the incident occurred.
Martinez claims the alleged confrontation was not an isolated incident.
The French actor alleges Berry has previously wrestled with Maceo and forced the 12-year-old to “tap out,” claiming their son has become fearful that his mother could place him in another chokehold.
Martinez also referenced Berry’s extensive mixed martial arts training for her 2021 directorial debut, Bruised, alleging she has used fighting techniques during physical confrontations with their son.
The claims have not been proven in court.
Halle Berry Denies Olivier Martinez’s Abuse Allegations
Berry’s legal team is pushing back hard against Martinez’s version of events.
Her attorney, Marina Beck, described the filing as “entirely meritless and deliberately misleading.”
Berry’s legal team has instead pointed to the former couple’s long-running disagreements over Maceo’s education and therapy, alleging Martinez has previously interfered with court-ordered therapeutic and educational interventions involving their son.
The latest accusations come after years of legal conflict between Berry and Martinez over custody and parenting decisions.
Judge Grants Temporary Restraining Order Against Halle Berry
Following Martinez’s filing, a Los Angeles County judge granted him a temporary restraining order against Berry.
The temporary order restricts Berry’s contact with Martinez while the custody dispute moves through the courts.
Berry is still permitted to see Maceo during court-ordered visitation as the case remains unresolved.
Martinez is reportedly seeking sole legal and physical custody of their son.
The former couple has also been ordered to participate in confidential mediation as they attempt to resolve their latest custody dispute.

Berry and Martinez married in 2013 before announcing their separation in 2015.
However, their divorce was not finalized until 2023 following years of legal proceedings surrounding finances and custody of Maceo.
The former couple initially agreed to share legal and physical custody of their son, but their co-parenting relationship has repeatedly spilled into court.
Now, Martinez’s allegations and the temporary restraining order have brought their custody battle back into the spotlight.
A court hearing is scheduled for October 16, when the judge can reconsider the temporary restrictions and address the ongoing custody dispute
