Halle Berry is breaking her silence amid serious child abuse allegations involving her son, Maceo, as new photos show the actress spending time with him despite her ongoing legal battle with ex-husband Olivier Martinez.
According to PEOPLE, Berry denied the accusations in an October 5 court declaration, insisting that she has never physically or emotionally abused her son. The 60-year-old actress also submitted what she described as video evidence and text messages contradicting Martinez’s account of an alleged September 26 incident.
“I have never physically, emotionally, or otherwise abused Maceo,” Berry stated, adding that she is a survivor of domestic violence and would never intentionally harm her child.
Halle Berry Disputes Olivier Martinez’s Allegations
The controversy began after Martinez accused Berry of physically assaulting their son during a disagreement over a virtual reality game.
In court documents, Martinez alleged that Berry became angry with Maceo, placed him in a headlock, and choked him. He also claimed that similar incidents had occurred previously.
Berry, however, has offered a different account.
According to her declaration, she entered Maceo’s room to tell him to stop playing video games and began recording him. When he noticed the phone, he reportedly grabbed it, leading to what Berry described as playful roughhousing.
The actress acknowledged that the situation eventually escalated but maintained that she never choked her son, restricted his breathing, or placed him in a headlock.
Berry instead alleged that Maceo became upset and pushed her, prompting her fiancé, musician Van Hunt, to intervene.
She also disputed suggestions that her subsequent messages to Martinez amounted to an admission of abuse, explaining that she was expressing frustration over how the interaction had unfolded.
Halle Berry Spotted With Son Maceo in New Photos
Despite the ongoing legal dispute, Berry has continued spending time with her son.
On October 4, the actress and Hunt accompanied Maceo to a Sky Zone trampoline park in Los Angeles, where the teenager played indoor soccer.
An eyewitness told PEOPLE that Berry appeared “pretty subdued” during the outing and largely kept to herself while watching her son.
The actress reportedly declined a fan’s request for a photograph, explaining that she was spending time with her child.
Berry was also photographed shopping with Maceo and Hunt at a Best Buy in Los Angeles, marking another public sighting of the family following Martinez’s allegations.
The appearances came days after a judge granted Martinez a temporary restraining order on October 1, restricting Berry’s parenting time while allowing scheduled daytime visits.
Halle Berry’s Daughter Nahla Aubry Defends Her Mother
Berry’s eldest daughter, 18-year-old Nahla Aubry, has also stepped forward to defend her mother.
In a declaration obtained by Page Six, Nahla described Berry as a loving and devoted parent who sometimes enforces strict rules but has never displayed abusive behavior toward her younger brother.
“I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way,” Nahla stated.
She also challenged Martinez’s separate allegations that Berry had made racially insensitive remarks, saying her mother has consistently encouraged both children to embrace their identities and respect people from different backgrounds.
Nahla admitted that she was “shocked, very sad and very upset” upon learning about the allegations.
The 18-year-old further described her mother as deeply involved in her children’s lives, from attending sporting events to supporting their education and personal development.

The allegations have intensified an already contentious custody dispute between Berry and Martinez, who finalized their divorce in 2023.
Martinez is seeking sole custody of Maceo, while Berry has requested that the court reinstate their previous 50/50 custody arrangement.
Martinez has maintained that his actions are motivated by concerns for their son’s safety and well-being.
For now, the temporary restraining order remains in place, with another court hearing scheduled for October 16, 2026
